MachOne — Terms of Use

01The Agreement

These Terms are an agreement between you and Corbin Tucker, an individual developer in Georgia, USA, who makes MachOne (“the developer”).

MachOne is licensed to you under Apple’s Standard End User License Agreement (EULA), as presented on the App Store. These Terms supplement that EULA; if they conflict, the EULA controls. By using MachOne, you agree to these Terms and the EULA.

02Apple

These Terms are between you and the developer only, not Apple. Apple is not responsible for MachOne or its content and has no obligation to provide maintenance or support for it. If MachOne fails to meet a warranty that applies to it, you may notify Apple, and Apple will refund any price you paid for it; to the extent the law allows, Apple has no other warranty obligation for MachOne.

The developer, not Apple, is responsible for handling any claim about MachOne or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that it infringes someone else’s intellectual property.

You confirm that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties. You must follow the terms of any third-party service you use along with MachOne. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

03What MachOne Is — and an Honest Limitation

MachOne is a content blocker for Safari. It blocks ads, trackers, cookie and consent banners, and cryptominers; defends against some fingerprinting; finds and blocks some trackers disguised as part of the website you are on, by looking up that website’s own addresses through your device’s DNS; and lists links whose text shows a different address (see Link Text and Addresses). It does this using community-maintained filter lists plus its own in-page defenses.

MachOne’s Protection Benchmark tests MachOne’s current rules on your device against a fixed set of known ad, tracker and cryptominer addresses. It runs only when you start it. To compare, the test first loads those addresses without blocking, so running it contacts those servers.

MachOne’s features change over time as websites, filter lists and Safari change.

04Link Text and Addresses

When you open MachOne’s popup in Safari, it can list links on the page whose text shows a different web address than the one the link uses, and link addresses that begin with another web address. This check runs on your device, only when you open the popup, and sends nothing anywhere. It reports what the page’s own link text and link addresses say; it does not judge any link, website or person.

It does not compare every link: it lists a link only in certain specific cases, leaves out many common kinds of redirect and link tracking, reads only the page itself and not frames inside it, stops after a short time, and does not run on sites where you have paused MachOne. When it finds nothing to list, or cannot run, it shows nothing. A link that is not listed has not been approved, and may not have been compared at all.

Treat the list as information, not advice, and decide for yourself before you open a link. If a listing looks wrong, “Report a Mistake” opens an email to the developer; nothing is sent unless you send it.

05Websites You Visit

MachOne changes how websites look and behave. It blocks requests, hides parts of pages, removes ads (including on YouTube), and chooses “reject” or “decline” in cookie and consent dialogs when it finds that choice. It also closes or removes some notices that cover a page and offer no way to decline, and some pop-ups that ask for your email address or a free sign-up. It dismisses YouTube’s messages asking you to turn off your ad blocker and removes similar messages on other websites.

When MachOne closes or removes a notice instead of choosing “reject” or “decline,” how the website treats that is up to the website. You are responsible for how you use each website and for following its terms. MachOne is designed to leave paywalls and login screens in place, and you may not use it to get around them.

06Acceptable Use

You may use MachOne on Apple devices you own or control, as the EULA permits. You agree not to misuse the app — including attempting to repackage or resell it, or using it to interfere with services in ways unrelated to its purpose as a content blocker.

MachOne’s own code and the MachOne name belong to the developer; filter lists and other third-party material belong to their owners. These Terms don’t give you any right to them beyond using the app.

07Third-Party Filter Lists

MachOne downloads filter lists published by third parties (EasyList, EasyPrivacy, Fanboy’s lists, AdGuard Base, AdGuard Mobile Ads, NoCoin, CoinBlockerLists, Peter Lowe’s list, and regional lists matched to your device’s languages). These lists remain the work of their authors under their own licenses, credited on the Support page. Their availability and contents are outside the developer’s control.

MachOne checks every list it downloads before using it: it rejects empty files, error pages, lists with almost no rules, and lists that have shrunk to less than half their largest size, and it removes rules that would let well-known trackers back through. If a list fails once, MachOne keeps the rules it already has; if the same list keeps failing, MachOne leaves it out and keeps updating the others until it works again.

If you add filter lists of your own by web address, MachOne downloads each list you add from the address you give, whenever it updates its own lists. You are responsible for the lists you add and for having the right to use them; the developer does not review them. A list you add that fails to download or fails MachOne’s checks is skipped.

08No Warranty

To the maximum extent permitted by law, MachOne is provided “as is” and “as available,” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

09Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of MachOne — including content that was or was not blocked, any website’s behavior with blocking enabled, or anything MachOne shows or does not show, including Link Text and Addresses, the trackers it finds, and Protection Benchmark results. In any event, the developer’s total aggregate liability shall not exceed the amount you paid for the app and any in-app purchase. Some jurisdictions do not allow certain liability limits, so parts of this section may not apply to you.

10Purchases and Refunds

MachOne is currently free to download and use, and it offers no in-app purchases: nothing in it is sold or locked behind a purchase. MachOne Pro, an optional one-time in-app purchase offered earlier, and the optional tips are no longer sold.

If you bought MachOne Pro earlier, MachOne Pro features added later remain included with that purchase at no extra charge. Refund requests for earlier purchases, including tips, are handled by Apple at reportaproblem.apple.com under the App Store’s terms.

11Ending These Terms

You can stop using MachOne at any time by deleting it. Your rights under these Terms end automatically if you don’t follow them. The Apple, No Warranty, Limitation of Liability, Governing Law and Whole Agreement sections continue to apply after that.

12Changes

If these Terms change, the new version will be posted on this page with a new effective date. A change does not take away a MachOne Pro purchase you already made. If you keep using MachOne after a change, the new Terms apply.

13Governing Law

Matters these Terms cover are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules, except where the law of your place of residence necessarily applies. Apple’s EULA is governed by the law it names.

14Whole Agreement

These Terms and the EULA are the whole agreement between you and the developer about MachOne. You may not transfer them; the developer may transfer them to a successor. If any provision is found unenforceable, the rest remains in effect.
